CICCC Update—5 August 2004 Meeting

Terminals’ progress in implementing improvements at Coode Island

Terminals’ EPA licence for the operation of its storage facility at Coode Island requires specified improvements which are set out in an Environment Improvement Plan. As this plan is only reviewed every three years, at the request of the CICCC an Improvement Action Report has been prepared by Terminals, and is updated regularly. The Improvement Action Report details the progress Terminals has made in improving the standard of their facility, and records whether the regulatory authorities (EPA and WorkSafe) are satisfied with the work undertaken by Terminals.

At its meeting on 5 August 2004, the CICCC commenced a detailed review of the Improvement Action Report. The review will be completed at its next meeting in October, and the completed review will be posted on the CICCC web site (

Carlo Fasolino, Terminals’ Victorian Manager, told the Committee “We have completed most of the items on the list, though some of the items relating to our consolidation on the west side of Mackenzie Road have been delayed. The delay is in accord with our agreement with Government to extend the period of operations from the east side, to provide continuity of supply to customers while the Marstel facility is constructed.”

Safety case review

Bronwyn Brookman Smith from WorkSafe presented a stakeholder evaluation report to the Committee on the Post Assessment Safety Case Review undertaken by Sweeney Consultants. Sweeney interviewed 132 CEO’s, Managers and OH&S representatives from Major Hazard Facilities following the implementation of the new Safety Case Regulations. The report concludes:

“Over 80% of Major hazard Facilities claimed that their organisations have gained value from having a documented Safety Case. Despite the reported inefficiencies, frustrations and costs involved, this is a very positive outcome.

“An impressive two-thirds of all respondents expressed the opinion that there is a greater consensus and focus on safety in their organisation as a result of the Safety Case.

“The licensing process would have been easier if MHF operators had been provided with good Guidance Notes at the start of the process – a lesson for the future.”

Phenol storage proposal on hold

Terminals advised the meeting that the phenol storage will proceed at the facility, for Orica. Phenol is a toxic substance, and will cause severe burns on contact with skin. While a Works Approval is not required, Terminals is finalising an information document for the EPA, and a copy will be provided to the CICCC.

Relinquishment of East Side leases

Terminals outlined the steps for their relinquishment of the east side of Mackenzie Road as follows:

  • Tank product drawdown — schedules have been provided to customers, so that the tanks will be empty by 30 November 2004.
  • Tank demolition — tenders will be sought in a month or so.
  • Site remediation — EPA has agreed to contaminated soil being carted to landfill. Tenders will be sought in a month or so.
  • Site hand-over to P&O Ports — 31 January 2006

Next meeting of the CICCC

The next meeting of the CICCC will be held on Thursday 14 October 2004 at the Maribyrnong Town Hall on the corner of Hyde and Napier Streets, Footscray at 6.30 pm. Members of the public are welcome to attend the meeting. The Committee will continue the review of Terminals’ Improvement Action Report.
